02Who we are

The webshop chromatcg.nl is run by:

Chroma TCG

Website

You can reach us by email at info@chromatcg.nl, through the chat on the website and on Instagram at @chromatcg.nl. We answer on working days, usually within a day.

03When these terms apply

  1. 3.1These terms apply to every offer by Chroma, every order, every sale concluded at a distance and every purchase of cards by Chroma from a customer.
  2. 3.2Before a contract is concluded, these terms are available on the website, where you can save and print them. Ask and we email them to you free of charge.
  3. 3.3Where we agree something specific with you, that agreement applies. It can never leave you as a consumer worse off than the law does.
  4. 3.4If a provision of these terms turns out to be void or is annulled, the rest remains in force, and we replace that provision with one that comes as close as possible to what it meant.

04The offer

  1. 4.1Most of what we sell is one of a kind. For single and graded cards, the photos show the exact copy you buy. For sealed product and accessories a photo may show the product in general.
  2. 4.2We describe condition, grade, set, card number, language and any flaws as accurately as we can, so you know exactly what you are buying.
  3. 4.3An offer is without obligation until you have ordered the product; until then it can be sold to someone else.
  4. 4.4Obvious mistakes in an offer, such as a misplaced decimal point in a price, do not bind us. We contact you before anything happens.
  5. 4.5Every offer shows the price including VAT. The shipping costs, how the sale is concluded, how payment and delivery work and whether the right of withdrawal applies are set out in the bag, in the confirmation and in these terms.

05Ordering and the sale

  1. 5.1You order one or more products with your account — we want to know who is buying a one-of-one card and where it is going.
  2. 5.2Before you place the order, the bag shows the products, the shipping costs and the total. You can still correct mistakes there.
  3. 5.3You place the order with the button that says it comes with an obligation to pay, and then pay straight away through iDEAL. Your order becomes final once we have received your payment; see Payment.
  4. 5.4After placing your order you receive a confirmation by email with your order number and the total. Once your payment has arrived, we confirm the sale by email, together with these terms and the information about the right of withdrawal.
  5. 5.5We may refuse or cancel an order for a good reason, such as abuse or an obvious mistake in the offer. We tell you why, and if you have already paid, we refund you straight away.

06Prices

  1. 6.1All prices are in euros and include VAT.
  2. 6.2Shipping costs are shown separately in the bag and in the confirmation. Above the threshold shown in the bag, shipping is free.
  3. 6.3The price at the moment you place your order is the price for that order, even if the price on the site changes afterwards.

07Payment

  1. 7.1Payment is made exclusively through iDEAL. You pay directly when you complete your order.
  2. 7.2Your order only becomes final and is only handled once we have received your payment. We ship your order as soon as possible after receiving the payment.
  3. 7.3If you have not paid within 24 hours of placing your order, your order lapses automatically and we no longer reserve the products for you. You can then order again, subject to the stock available.
  4. 7.4We never ask for your PIN, your bank login or your card details. You pay only through the iDEAL environment of your own bank.
  5. 7.5If you notice inaccuracies in payment details provided or stated, you must report them to us immediately.
  6. 7.6If a payment remains outstanding after a reminder sent by us, we are entitled, subject to legal limits, to charge the reasonable collection costs made known in advance.

08Delivery and risk

  1. 8.1We ship within the Netherlands and the European Union. Outside the EU only by arrangement.
  2. 8.2We ship on the working day your payment arrives, or the next one if it arrives after 15:00. We deliver within 30 days of the sale at the latest, unless we agree otherwise. If we cannot, we tell you and you may cancel the sale at no cost; we then refund you straight away, within 14 days at the latest.
  3. 8.3Everything is shipped insured and with track & trace, packed to protect it: sleeve, toploader and a sturdy envelope for single cards, foam and a double-walled box for slabs.
  4. 8.4The risk of loss or damage stays with us until the parcel has been delivered to you or to someone you named.
  5. 8.5The address you give us is the delivery address.

09Right of withdrawal

When products are delivered:

  1. 9.1

When buying products, the consumer may dissolve the contract within 14 days without giving reasons. This cooling-off period starts on the day after the product is received by the consumer or by a representative the consumer appointed in advance and made known to the trader.

  2. 9.2

    Careful handling and inspection

    • The consumer will handle the product and its packaging with care
    • The consumer may unpack the product ONLY for inspection purposes
    • For sealed products (booster boxes, cases, blisters): the seal and packaging may NOT be opened
    • Opening the seal or packaging means the product is damaged and can no longer be returned
    • The customer accepts that the contents of sealed products are random and are not a ground for return
  3. 9.3

    Return notification process

    • A consumer who wishes to use the right of withdrawal must make this known to the trader IN WRITING AND WITH REASONS within 14 days of receiving the product
    • The consumer must send photos of: (1) the front of the product/packaging, (2) the sides/back, (3) the seal or closures (must be intact)
    • Without photos as evidence, the return notification is rejected
    • The trader compares these photos with the arrival photos in our archive
    • After making known that they wish to use the right of withdrawal, the customer must send the product back within 14 days
    • The consumer must prove that the delivered goods were returned in time
  4. 9.4

    Acceptance conditions

    • The product must come back in its original, sealed condition
    • No dents, scratches, water or other damage to the packaging
    • The seal MUST be intact (no cracks, peeled off, etc.)
    • Only products in acceptable condition can qualify for approval
    • Opened products: automatically rejected, no return possible
  5. 9.5

If, after the periods have passed, the customer has not made known that they wish to use the right of withdrawal, or has not sent the product back to the trader, the sale is final.

10Costs in case of withdrawal

  1. 10.1

Refund only under the following conditions

    • The product is received in its original, sealed condition
    • Photos demonstrably show an intact seal and no damage
    • The product is sent back within the set period
    • Inspection by Chroma TCG confirms an acceptable condition
  2. 10.2

    Return costs

    • The direct cost of returning is ALWAYS borne by the consumer
    • Chroma TCG does not refund return postage or shipping costs
    • The customer must buy a shipping label themselves
    • The customer must submit supporting evidence
  3. 10.3

    Restocking fee on return

    • An approved return (sealed product intact) carries a restocking fee of 15% of the purchase price
    • Example: €100 purchase = €85 refund
    • This fee covers inspection, administration and storage costs
  4. 10.4

    Rejection and no refund

    • Product not in acceptable condition: no refund
    • Seal broken/damaged: no refund
    • Photos missing or insufficient: no refund
    • The customer receives a message with photos explaining why the return was rejected
  5. 10.5

    Refund process

    • Chroma TCG receives the product and inspects it (max. 10 working days)
    • On approval: refund minus restocking fee within 14 days
    • The refund is made via the same payment method as the purchase
    • The customer should allow 5-10 extra working days for bank processing

11Exclusion of the right of withdrawal

  1. 11.1

The trader may exclude the consumer's right of withdrawal for products as described in paragraph 2. The exclusion applies only if the trader stated this clearly before the contract was concluded.

  2. 11.2

The right of withdrawal is excluded for

    a) Sealed products with a broken seal

    • Products whose seal, packaging or closure has been broken, opened or damaged
    • This is assessed on the basis of photos and physical inspection
    • A broken seal = a damaged product = not returnable
    • On purchase, the customer accepts that opening the product has consequences
    • The customer accepts that the contents of sealed products (pull quality, card condition, etc.) are not a ground for return

    b) Products altered by the consumer

    • Products the consumer has opened, used or otherwise worked on
    • Products whose packaging was damaged through use by the consumer
    • Products with inflicted damage (scratches, dents, water damage, etc.)

    c) Normal wear and manufacturing defects

    • Chroma TCG is NOT liable for manufacturing faults on the cards INSIDE the product
    • Contents (pull quality) are never a ground for return
    • For manufacturing faults on cards: contact the manufacturer directly (The Pokémon Company, etc.)

    d) Uninspected products

    • Products for which no photos have been submitted as evidence of inspection
    • Products without photo documentation cannot be accepted
  3. 11.3

The exclusion therefore does NOT apply to:

    • Unopened sealed products delivered in their original condition (the right of return applies to these)
    • Products that were delivered damaged BY US (these are replaced/refunded)

12Condition & contents of products

  1. 12.1

    Product condition & acceptance

At the moment of purchase, the customer expressly accepts that:

    1. All sealed products (booster boxes, cases, blisters, mystery boxes, etc.) are delivered in their existing condition
    2. The customer inspects the product only visually from the outside for acceptance
    3. Opening the seal or packaging is NOT permitted for inspection purposes
    4. The customer agrees that sealed products cannot be opened without the return rights lapsing
    5. Chroma TCG is NOT liable for the contents of sealed products (pull quality, condition of cards, etc.)
    6. Chroma TCG is NOT liable for minor/normal manufacturing defects on cards INSIDE the product
    7. The customer acknowledges that trading card contents are random and not subject to any guarantee
  2. 12.2

Damage to cards from opened packs

If the customer chooses to open the product (and so loses the right of return):

    • When sealed products are opened, cards may show manufacturing damage
    • Chroma TCG has no influence on production or packaging by the manufacturer
    • Chroma TCG accepts NO responsibility for card conditions after opening
    • For defective cards: contact The Pokémon Company directly via support.pokemon.com
  3. 12.3

A “bad pull” is NOT a ground for return

    The customer acknowledges that:

    • The contents of booster packs are random
    • A “bad pull” (few valuable cards) is NOT a reason for return
    • Pull quality does NOT fall under guarantee or conformity
    • The customer cannot demand a return because the cards are not to their liking

13Return policy

  1. 13.1

Web shop return policy (distance sales)

    For sealed products

    • Right of return: 14 days (under the article Right of withdrawal)
    • CONDITION: the product must be in its original, sealed condition
    • REQUIRED: photo inspection with evidence
    • COSTS: the customer pays the return postage
    • RESTOCKING FEE: 15% of the purchase price on an approved return
    • REJECTION: opened/damaged products = no return, no money back

    For single cards (singles)

    • No right of return (under the statutory exclusion for used goods)
    • Not returnable under any circumstances
  2. 13.2

What Chroma TCG DOES take back

    1. Products that arrive damaged on delivery (physical damage to the packaging shown by photos)
    2. Products NOT delivered as ordered (wrong product/quantity)
    3. Sealed products in acceptable condition without visible damage
    4. Only if the customer follows the procedure correctly (photos, notification period, etc.)
  3. 13.3

What Chroma TCG does NOT take back

    1. Opened/unsealed products (seal broken = automatically rejected)
    2. Products with bad pulls or unwanted contents
    3. Products damaged through use by the consumer
    4. Products without photo inspection evidence
    5. Single cards/singles
    6. Products without a return notification within the period
    7. Products without proof of return postage
    8. Products whose inspection shows a rejection (the photos cannot justify it)

14Photo evidence & inspection

  1. 14.1

Required photos with a return notification

With a return notification, the customer MUST submit the following photos digitally:

    1. Front: the whole product visible with the Chroma TCG sticker/label
    2. Sides: all four sides visible
    3. Back: the whole back panel visible
    4. Seal/closure: close-up of the seal with the date visible (must be intact)
    5. Date: the photos must show the current date

No photos = return automatically rejected

  2. 14.2

    Inspection by Chroma TCG

    1. Chroma TCG checks the photos against the archived arrival photos
    2. Chroma TCG compares the seal, packaging and condition
    3. On rejection, the customer receives a specific message with the reasons (photos)
    4. On approval: the return procedure is started
    5. Inspection takes max. 10 working days

15Conformity, authenticity and guarantee

  1. 15.1We guarantee that a product matches its description and photos and has the properties you could expect from them. That is the statutory guarantee; nothing in these terms limits it.
  2. 15.2Every card we sell is genuine. If a card turns out to be demonstrably not genuine, we refund the full amount including shipping costs, also after the withdrawal period.
  3. 15.3The grade on a graded card is the judgement of the grading company, such as PSA or BGS. We vouch for a genuine, undamaged holder and a certificate number that matches that company's database — not for whether another company or a regrade would arrive at the same grade.
  4. 15.4Single cards are described on the condition scale stated in the listing, such as Near Mint or Excellent. That is an assessment by eye; small differences of opinion fall within it.
  5. 15.5If something arrives that is not as described, tell us within a reasonable time after you notice — within two months is always in time — with a photo. We put it right, replace it where possible, or refund you including the cost of returning it.

16Complaints

  1. 16.1Mail your complaint with your order number and a clear description to info@chromatcg.nl, as soon as possible after you notice the problem.
  2. 16.2We confirm receipt and give you a full answer within 14 days. If we need longer, we tell you within those 14 days when you can expect it.
  3. 16.3If we cannot solve it together, applicable law and disputes explains where you can go.

17Communication & disputes

  1. 17.1

    Submitting return requests

The customer submits a return request by email: info@chromatcg.nl

    The email must contain:

    • The order number
    • A clear reason for the return (only valid: packaging damaged on arrival, wrong product)
    • 4-5 clear photos as described in the article Photo evidence & inspection
    • Willingness to send the product back
  2. 17.2

    No disputes without photo inspection

    • All disputes must first be resolved through specific photo inspection
    • The customer cannot file a claim without photo evidence
    • RTB offer: the customer can escalate to the Complaints Institute (Geschillencommissie)

18Selling to Chroma

  1. 18.1You can offer us cards, graded cards, sealed product or a whole collection through the sell form. A request is without obligation.
  2. 18.2We offer 70% of the current market value. We set the market value from completed sales of the last 60 days — on eBay, Cardmarket and the Japanese second-hand market, among others — for exactly your print, language, condition or grade. We offer per card or, for a larger lot, for the lot as a whole, and you receive the sales we based it on.
  3. 18.3If you choose store credit instead of a bank transfer, we add 10% on top of the offer. Credit is for purchases at Chroma and is not paid out in money.
  4. 18.4You receive the offer in writing, by email, within 48 hours of your request. It is valid for 7 days. Until you accept, you are not committed to anything.
  5. 18.5Once you accept, we send you a prepaid, insured shipping label. Pack the cards as we describe. While the parcel travels on our label, the risk is ours, up to the amount of the offer.
  6. 18.6On arrival we check every card for authenticity and condition. If it matches your description, we pay on the day the parcel is checked in. If the condition differs, we make an adjusted offer; if you do not accept it, we send everything back insured and at our cost.
  7. 18.7We do not buy a card that is not genuine; we send it back. If we suspect theft or fraud, we may report it and hand the cards to the police.
  8. 18.8By selling to us you declare that the cards are yours, that you are free to sell them, that nobody else has rights to them and that, as far as you know, they are genuine. You are 18 or older, or have permission from a parent or guardian.
  9. 18.9Ownership passes to us the moment we pay the amount or add the credit to your account.
  10. 18.10We may decline a request, or part of it, without giving a reason.

19Liability

  1. 19.1

Chroma TCG is liable for damaged products ONLY if:

    • The customer submits photos with evidence
    • The damage was demonstrably caused by Chroma TCG (not the consumer)
    • The customer files a complaint within 24 hours of receipt
  2. 19.2

Chroma TCG is NOT liable for:

    • Contents/pulls of sealed products
    • Card conditions after opening
    • Damage through use by the consumer
    • Production/manufacturing defects on the cards themselves
    • Loss of market value through delay or other reasons
  3. 19.3

Maximum liability: the purchase price of the product (minus the restocking fee)

20Personal data

  1. 20.1We handle your data with care and only use it for what it was given for. How exactly is set out in our privacy statement.

21Applicable law and disputes

  1. 21.1Dutch law applies to these terms and to every contract with us. If you are a consumer living in another EU country, you keep the protection of the mandatory rules of that country.
  2. 21.2If we cannot resolve a dispute together, it can be brought before the competent court in the Netherlands. As a consumer you may also go to the court where you live.

22Changes

  1. 22.1We may change these terms. The new version applies from the date at the top of this page, to orders and requests made after that date. An order or request already under way stays under the version that applied when you made it.
